Confidentiality & Release of Information

It is the policy of ELim Therapy: Music & Arts, LLC to safeguard the privacy of all of its clients and to protect the confidentiality of clients’ personal, sensitive, and protected health information (collectively referred to as “Information”). All information received and/or obtained through ELim Therapy, LLC is confidential. No one is permitted to share any information obtained at ELim Therapy, LLC. All clients’ information is kept in folders in a monitored and locked area for confidentiality. ELim Therapy, LLC will only release information from the record with a client’s signed Release of Information.

ELim Therapy, LLC may be required to breach confidentiality in the following situations:

  • Written consent: A client may provide written consent for the therapist or clinician to disclose specific information to a third party.

  • Court orders: The court may demand access to records and counselor testimony (not an attorney’s request).

  • Client complaints and litigation against counselor: ELim Therapy, LLC has a right to defend itself against malpractice claims.

  • Other client litigations: The client may initiate civil action against someone and grant written consent to release confidential information.

  • Duty to report: ELim Therapy, LLC is legally obligated to report events such as child or elderly abuse and neglect.

  • Duty to warn or Protect: ELim Therapy, LLC is legally required to take reasonable precautions if the client poses a danger to themselves or others.

  • Clients planning future crimes: If the client discloses an intention to commit a crime in the future, the therapist or clinician is required to report it. Past crimes are not required to report unless future criminal behavior is likely to occur and future harm to a third party might be averted by reporting.

  • Reimbursement or billing of fees: Disclosure is necessary to administer payment.

  • Clients with contagious life-threatening diseases: If a client is tested positive and their behavior puts others at imminent risk of infection, ELim Therapy, LLC is required to report it to the affected third party.

  • Clients considering and/or threatening hastening their deaths: Disclosure is required to protect clients or identified others from serious and foreseeable harm or when legal requirements demand that confidential information must be revealed.

  • Emergencies or hospital emergency room: Limited disclosure if client’s health is seriously or imminently at risk.

  • Confidentiality with minors: Treatment information is accessible to parents/guardians of clients who are minors or under the care of a consenting adult.

  • Group therapy: Group members will be present during confidential discussions between clients and therapist(s) or clinician(s) during the session.
